Thank you for choosing Evergreen Escape Adventure to plan your trip. Please note that by booking any of our travel products or services, you are entering into a contractual relationship with us and agreeing to the following terms and conditions:
It is essential that you carefully read and understand these Terms before booking.
By booking a Product with us or traveling on an Evergreen Escape Adventures tour, you acknowledge that you have read and understood these Terms and agree to be bound by them.
DOWN PAYMENT & FINAL PAYMENT
To ensure your reservation, we require a deposit upon booking. The deposit amount will depend on the type of tour you choose. For camping safaris, day tours, and Kilimanjaro climbs, the deposit is typically 30% of the total booking value. For reservations that include hotels and lodges (including glamping safaris), the deposit is 45%. Once you book your tour, we will send you an invoice and payment instructions. After we receive your deposit, we will confirm your reservation and provide you with a confirmation and receipt.
Please note that the final balance is due no later than 14 days before the tour begins, and you should factor in the time required for bank transfers. A booking will be considered as canceled by the client if we have not received the final balance at least 14 days before the start of the tour. This will be considered as a cancellation received 14 days before the start of your tour, and the applicable cancellation fee will be charged, as described in Article 3 of these terms and conditions.
If you make a reservation less than 14 days before your tour starts, it should be paid in full upon booking.
For particular tours, exceptions to these typical amounts and delays may arise and will be mentioned in the offer we send you. In all situations, and without exception, your tour must be fully paid for before it begins. If Evergreen Escape Adventure has not received full payment by the trip’s departure time, we reserve the right to refuse entrance to the tour, and any deposit already collected by Evergreen Escape Adventure will not be reimbursed.
If you are in Arusha or Moshi at the time of your booking, you can pay by bank transfer or cash/credit card. There are currently no other payment options available. Please be aware that we are a tour company registered in Tanzania, and that any money transferred from a European bank account, for example, will be deemed an international transfer. You, the client, will be responsible for any charges associated with any payment (such as credit card transaction fees, bank fees, and so on), both on your end and ours. It is also critical that you declare throughout your transfer that ALL charges are to be deducted from your account (and not that the costs should be shared). In case of differences, the amount that will be taken into consideration is the amount that appears on our bank account, even if you’ve indicated that all costs had to be taken from your account. All prices and offers on our website are in USD, and payments can be made in USD (US dollars).
For bank transfers, we use USD as the standard currency, and the account number of our USD bank account may be found in the bank data attached to each invoice. For cash payments, the conversion will be based on the exchange rate at the time of payment. When paying for your tour or a portion of it in cash, please keep in mind that only USD coined after 2006 (thus beginning in 2007) will be accepted. Please keep in mind that ATMs in Tanzania are frequently empty or out of service, and cash withdrawals are restricted. You will not be allowed to withdraw more than USD 170 for each transaction per card, and you will be limited to 3 transactions per day per card (regardless of your card limit). Most exchange bureaus in Tanzania have closed, and you may only change money in banks during their operating hours.
The availability and booking status of hotels and lodges, as well as any other service or activity for which we as a tour operator must pay a deposit to a third-party supplier, can only be completely confirmed once we receive your money and check availability at that time.
AGREEMENT FOR BOOKING
Please be aware that, under our Booking Agreement, all bookings require an applicable deposit and the complete balance must be paid by the specified dates. If you make a booking within this timeframe, the full amount must be paid upon booking. Please note that failure to provide the complete balance by the due date may result in the booking being canceled, and appropriate cancellation charges may apply.
We would like to emphasize that late bookings are accepted at the discretion of the director. In the event of payment delays on your part, please understand that Evergreen Escape Adventure cannot be held responsible for lost accommodation or activity bookings.
To confirm your booking, you must be at least 18 years old and agree to provide full, complete, and correct information as requested.
When scheduling a tour for more than one person (Group), you must confirm the following:
- The other participants have permitted you to make a booking on their behalf, and you’ve given them all the necessary information for them to give free and fully informed authorization to do so.
- The information that you’ve provided regarding all clients is complete and accurate, and you’ve obtained all necessary consents and permissions to share such information with Evergreen Escape Adventure to complete the booking.
- Bookings can only be accepted for persons under the age of eighteen years of age when accompanied by an adult who will be responsible for them. There are some activities that children cannot participate in, please check with us for more details.
CANCELATION POLICY
Cancellation of bookings is subject to our policy. If you wish to cancel your booking, you must send us an email at info@evergreenescapetz.com. Please note that cancellation fees will apply and will be calculated based on the date we receive your cancellation request. The fees are expressed as a percentage of the total price paid for the tour. It is important that you carefully review our policy before making any booking with us.
For basic camping safaris (private or in a group), private short trips and private Kilimanjaro/Meru climbs:
- Cancellation received 61 days or more before the tour starts: 30% cancellation fees will be charged
- Cancellation received 14 – 30 days before the tour starts, or failure to pay the final balance at least 14 days before the start of the tour, as required in article 1 of these terms and conditions: 50% cancellation fee will be charged
- Cancellation received 3 – 13 days before the tour starts: 75% cancellation fee will be charged
- Cancellation received within 48 hours before the tour starts or no-show: 100% cancellation fee will be charged
For all private reservations and all group safaris including hotels and lodges (including glamping safaris):
- Cancellation received 61 days or more before the tour starts: 30% cancellation fees will be charged
- Cancellation received 31 – 60 days before the tour starts: 50% cancellation fees will be charged
- Cancellation received 14 – 30 days before the tour starts, or failure to pay the final balance at least 14 days before the start of the tour, as required in article 1 of these terms and conditions: 75% cancellation fee will be charged
- Cancellation received 3 – 13 days before the tour starts: 85% cancellation fee will be charged
- Cancellation received within 48 hours before the tour starts or no-show: 100% cancellation fee will be charged
If you wish to cancel your participation in a group that has been formed for a day trip, short excursion, a climb, or any other excursion where the final price is determined by the number of people in the group, the cancellation fees listed above apply, and an additional fee may be charged to cover any potential loss in income since we have confirmed a lower price per person to the other participants in the group. This price will be computed at the time of your cancellation and will not be adjusted if new participants join the group later.
Some tours may have different cancellation policies, which we will advise you about when we send you, our offer.
If you have paid more than the appropriate cancellation charge to Evergreen Escape Adventure, your balance will be returned as soon as feasible. Any fees associated with this return are the responsibility of the client.
TRAVEL INSURANCE
Please note that it is mandatory to obtain personal travel insurance that covers all applicable dates of travel, including medical, evacuation, and repatriation coverage, if you decide to travel with Evergreen Escape Adventure. We do not provide travel insurance, and we will not be responsible for any losses or damages that may occur if you fail to obtain adequate insurance coverage. It is your responsibility to ensure that your insurance covers personal injuries, emergency medical expenses, cancellation, and all other expenses that may arise due to loss, damage, injury, delay, etc. Please inform your insurance company of the type of travel you plan to undertake to get the right type of insurance coverage.
MEDICAL CONDITIONS
Evergreen Escape Adventure does not provide travel insurance. All clients must obtain adequate travel insurance and provide the details to Evergreen Escape Adventure, who will keep them on file to assist in the event of an emergency (All clients are required to provide relevant medical information to Evergreen Escape Adventure upon booking their tour.). The customer should have the original documents with them at all times while on vacation. The insurance must consider the nature of the vacation, and the client must inform their insurance company if they expect to go climbing, trekking, diving, or on safari, among other activities. In the event of a serious accident, the policy should also include repatriation coverage. Clients are responsible for determining their eligibility and capability to participate in a tour with us and should consult their physician if in doubt.
We advise all clients to get medical advice regarding any necessary or recommended vaccines, medical precautions, or other medical issues for the duration of their trip. We can offer suggestions on these topics, but they should not be construed as medical advice.
Evergreen Escape Adventure programs include visits to rural or less developed areas of Tanzania, where medical services may not meet your home country’s standards. The state of medical facilities in these countries varies, and we make no representations or warranties about the quality of such facilities or medical treatment in the respective regions.
SPECIAL REQUIREMENTS
At Evergreen Escape Adventure, we are committed to doing our best to fulfill your special requests, such as dietary and accommodation needs. However, please note that these requests are not considered a part of our terms and conditions or the contract between you and us. Therefore, we cannot be held responsible for any failure to accommodate or fulfill such requests.
PRICES, SURCHARGES AND TAXES
Please note that due to the dynamic nature of the tourism industry in Tanzania and the fluctuating prices of the resources it relies on, the published price of any tour product is subject to change at any time, both before and after booking confirmation, up to 35 days prior to the departure of the tour. However, at Evergreen Escape Adventure, we only reserve the right to impose surcharges on tour products for reasons beyond our control, such as increases in accommodation costs, transportation costs, fuel costs, dues, taxes or fees chargeable for services such as third-party supplier costs, currency and exchange fluctuations, park fees, increases in taxes, or government actions that impact the price of applicable tours. We will exercise this right only where the increase in question is substantial enough to warrant the imposition of such surcharges.
Evergreen Escape Adventure must notify the affected client as quickly as practicable after learning of the need to apply a fee under this provision. Following notification by Evergreen Escape Adventure, the affected client(s) may choose between the following options:
(a) Cancel the applicable tour booking without incurring any penalty; or
(b) Accept the change of price.
The client must advise Evergreen Escape Adventure of their election within 14 days of receiving notification of the increase, or they will be regarded as having accepted the price adjustment and accepted responsibility for payment of the increase.
Evergreen Escape Adventure may provide discounted rates on some tours from time to time. The lower cost is only available for new bookings. Bookings that have already been confirmed (defined as bookings for which Evergreen Escape Adventure has received at least a deposit) are not eligible for the reduced rate.
EVERGREEN ESCAPE ADVENTURE GUARANTEED DEPARTURES & TOUR CANCELATION
Evergreen Escape Adventure confidently guarantees that all scheduled group tour departures booked by a client shall depart as planned, subject only to reasonable itinerary adjustments. Printed materials, including brochures and other tour information, may change and are not covered by this guarantee. However, once at least one client confirms their booking, the departure is guaranteed. Please note that this warranty does not apply to force majeure situations.
If Evergreen Escape Adventure cancels a tour before the agreed-upon departure date for reasons other than Force Majeure or the fault or negligence of or within the reasonable control of the client, the customer has the following options:
- Accepting from Evergreen Escape Adventure a substitute tour product of equivalent value, where such substitute is reasonably available; or
- Accepting from Evergreen Escape Adventure a substitute tour of lower value if no tour of equivalent value is reasonably available, and recover from Evergreen Escape Adventure the difference in price between the price of the tour originally purchased and that of the substitute tour; or
- Accepting from Evergreen Escape Adventure a substitute tour of higher value if no tour of equivalent value is reasonably available, and pay to Evergreen Escape Adventure the difference in price between the price of the tour originally purchased and that of the substitute tour; or
- Accepting from Evergreen Escape Adventure a full refund of all monies paid for the canceled tour.
Evergreen Escape Adventure is not responsible for any incidental or consequential losses incurred by the client as a result of the canceled booking, including but not limited to visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment. Evergreen Escape Adventure maintains the right, in its sole discretion, to give a full refund in lieu of the other options listed above.
If, after departure, a key feature of the tours as specified cannot be fulfilled, Evergreen Escape Adventure will make adequate alternate arrangements for the continuation of the trips. If a suitable replacement cannot be provided or if the client reasonably rejects any viable alternatives, Evergreen Escape Adventure will refund the client for unused tour products or tour product portions.
CANCELATION OF A TOUR BY THE CLIENT
If a client is unable to proceed with a booked tour, they can transfer their booking to another person who meets the tour’s requirements, provided that they inform Evergreen Escape Adventure of their intention to transfer no less than 14 days before the tour departure date. In such cases, the transferring client and the transferee client will be jointly and severally liable for paying the price of the tour and any additional costs incurred due to the transfer.
Similarly, if all members of a private tour wish to postpone their trip, Evergreen Escape Adventure can reserve the tour for a later date, but the clients will be responsible for paying all expenses already incurred by Evergreen Escape Adventure and a service fee of 100 USD per group. The client will also be responsible for any additional costs arising until the tour is taken at a later date, such as increased accommodation or transportation costs, third-party supplier costs, currency and exchange fluctuations, park fees, taxes, or government actions that impact the price of the tour. The exact amount will be communicated by Evergreen Escape Adventure, and all payments made by the client will be retained until the new tour date, with supplements for the new tour to be paid according to Article 1 of the terms and conditions.
CHANGES TO YOUR TOUR
As a client booking a tour with Evergreen Escape Adventure, you acknowledge that adventure travel, especially in Africa, requires flexibility and that reasonable alterations to the tour and/or itinerary may be necessary. You also acknowledge that the route, schedules, timings, accommodations, itineraries, amenities, and mode of transport may be subject to change without prior notice due to circumstances beyond the reasonable control of Evergreen Escape Adventure, such as sickness, mechanical breakdowns, incidents in the location where the tour is operated, flight cancellations, strikes, events stemming from political disputes, entry or border difficulties, extreme weather, and other unpredictable or unforeseeable circumstances.
Evergreen Escape Adventure will not be liable to pay any discounts or refunds for missed or unused services that were missed or unused by the client due to no fault of Evergreen Escape Adventure, its suppliers, or representatives. This includes any termination of the client’s participation in the tour due to the client’s fault, negligence, or breach of the Terms and Conditions.
While Evergreen Escape Adventure will strive to ensure that the tour goes as planned, it does not guarantee that it will abide by the agreed tour itinerary and reserves the right to amend it where necessary or advantageous. The company will strive to notify clients of any changes prior to the tour departure but is not obligated to do so and shall not be liable to pay any refunds that may be claimed to result from such changes.
In the unlikely event that reserved accommodation is no longer available due to reasons beyond Evergreen Escape Adventure’s control, the company will provide alternative accommodation in a hotel/campsite of at least the same category as originally contracted, if available. The client may be asked to pay the difference if there is an upgrade involved. Evergreen Escape Adventure will not be held accountable unless the problem is a result of their failure to book the accommodation/activity effectively.
If it is absolutely necessary to amend the tour itinerary during the tour, the tour guide will arrange the best available alternative, and their decision is final. This applies mainly to mountain climbing products where the guide believes the client is unable to continue due to illness, injury, extreme weather, or other factors beyond their control.
If the client wishes to make changes to their itinerary after confirmation of their booking, Evergreen Escape Adventure will make every effort to accommodate the requests based on availability. Additional costs may be involved, and payment should be made according to Article 1 of these Terms and Conditions.
RISK AND UNCERTAINTIES
The nature of the tour products offered by Evergreen Escape Adventure is adventurous and may involve a significant amount of risk to the client’s health, safety, and personal belongings. By confirming their booking of this tour, the client acknowledges that adventure travel has inherent risks and that they have considered such risks and are willing to assume them to the fullest extent legally possible. The client hereby assumes all such risk and releases Evergreen Escape Adventure from all claims and causes of action arising from any losses, damages, injuries, or death resulting from these risks inherent in travel, including adventure travel specifically, visiting wild and remote areas, and participating in adventurous activities such as those included in the tour itineraries.
The client acknowledges that the degree of personal risk involved depends on the nature of the tour or the location(s) in which such a tour is to operate. Therefore, the client acknowledges that there may be a significant degree of risk involved in travel on the tour, particularly if it involves physical activities, travel to remote locations, high-altitude activities, other high-risk activities, or travel areas with underdeveloped infrastructure.
The client acknowledges and agrees that Evergreen Escape Adventure will provide, to the best of its ability, information or guidance to the client with respect to local customs, weather conditions, specific safety concerns, physical challenges, or laws in effect in any location where tours are operated but will not be liable if the given information is incomplete or if the client does not act according to the information provided.
The client must at all times strictly comply with all applicable laws and regulations of Tanzania and the regions visited on the tour. Failure to comply with the above or committing any illegal act when on the tour may lead to the termination of the client’s travel arrangements on any tour immediately without any liability on Evergreen Escape Adventure’s part.
Clients are responsible for any costs incurred by Evergreen Escape Adventure as a result of damage, destruction, theft, or excess cleaning fees caused by the client while on tour. The client agrees to take all prudent measures in relation to their own safety while on any Evergreen Escape Adventure tour, including but not limited to, the proper use of safety devices such as seat belts, harnesses, and helmets and obeying all posted signs and warnings concerning client health and safety. The client’s failure to follow safety instructions or suggestions made by Evergreen Escape Adventure or its third-party suppliers is not the responsibility of Evergreen Escape Adventure or its third-party suppliers.
COMPLAINTS FROM THE CLIENTS
If you are participating in a tour with Evergreen Escape Adventure, it is important to bring any complaints or issues to our attention as soon as possible. This allows us the opportunity to address the problem and potentially make it right. Failure to do so may result in us being unable to resolve the issue or provide a refund. If you have a complaint, please inform the head guide or designated representative promptly. Any complaints made after the completion of the tour must be received in writing within 30 days of the end of the tour (e-mail is acceptable). Evergreen Escape Adventure will do our best to deal with legitimate complaints post-trip. It is helpful to provide any evidence you can gather at the time, such as photographs. Keep in mind that when determining whether a refund is due, we may need to negotiate with third-party suppliers (such as hotels). If you receive any acceptance of responsibility from a service supplier, please report it to us (possibly in a written statement) as it could speed up the compensation process.
THIRD-PARTY SUPPLIERS’ RESPONSIBILITY AND LIABILITY
Evergreen Escape Adventure works with various third-party suppliers, such as accommodation providers, activity providers, other tour operators, airlines, coach companies, transfer operators, shore excursion operators, tour and local guides, and other independent parties, to provide you with travel services and other services you purchase or which form the component parts of your tour. These third-party suppliers may also engage the services of local operators and/or sub-contractors to provide travel services that form part of the tour(s). Although Evergreen Escape Adventure takes all reasonable care in selecting third-party suppliers, it cannot control or supervise them and therefore cannot be responsible for their acts or omissions. The travel services and other services provided are subject to the conditions imposed by these suppliers, and their liability is limited by their tariffs, conditions of carriage, tickets, and vouchers, as well as the international conventions and agreements that govern the provision of their services. These may limit or exclude the liability of the supplier. Please note that third-party suppliers operate in compliance with the applicable laws of Tanzania, and Evergreen Escape Adventure does not warrant that any third-party supplier is in compliance with the laws of the client’s country of residence or any other jurisdiction.
Please note that to the fullest extent permitted by law, Evergreen Escape Adventure is not liable and will not assume responsibility for any claims, losses, damages, costs, or expenses resulting from inconvenience, loss of enjoyment, upset, disappointment, distress, or frustration, whether physical or mental, arising out of the act or omission of any party other than Evergreen Escape Adventure and its employees. It is also important to note that neither Evergreen Escape Adventure nor any carrier is liable for the acts or omissions, whether negligent or otherwise, of third-party suppliers or any independent contractors.
LIABILITY BOUND TO EVERGREEN ESCAPE ADVENTURE
Evergreen Escape Adventure is not liable for any damages, expenses, losses, or claims that are attributable to the fault of any client, the unforeseeable or unavoidable act or omission of a third party unconnected with the provision of any services that form any part of the tours, or a force majeure event. Evergreen Escape Adventure is also not responsible for loss, theft, or damage to clients’ baggage or personal effects during the tour. Clients are advised to take care of their belongings and not to leave them unattended in public areas or on board any mode of transportation.
In the event of any loss, death, injury, or illness caused by the negligent acts and/or omissions of Evergreen Escape Adventure or of any third-party suppliers of any services that form part of the contract, the liability of Evergreen Escape Adventure is limited by all applicable international conventions.
Compensation payments will not apply to changes caused by circumstances beyond our control, such as accidents, war, riots, civic strikes, terrorist activity, industrial disputes, natural disasters, fire, the closure of an airport or port, adverse weather conditions, or similar events. In regards to liability release and assumption of risk, clients must acknowledge and accept the inherent dangers, accidents, and hazards involved in participating in their trip, and that medical services and facilities may not be available while participating in their trip.
FORCE MAJEURE
Evergreen Escape Adventure shall not be held liable in any way to the client for any death, bodily injury, illness, damage, delay, or other loss or detriment to person or property, or financial costs, both direct and indirect, incurred, or for Evergreen Escape Adventure’s failure to commence, perform and/or complete any duty owed to the client if such death, delay, bodily injury (including emotional distress or injury), illness, damage, or other loss or detriment to person or property is caused by Act of God, war or war-like operations, mechanical breakdowns, terrorist activities or threat thereof, civil commotions, labor difficulties, interference by authorities, political disturbance, howsoever and where so ever any of the same may arise or be caused, riot, insurrection and government restraint, fire, extreme weather or any other cause whatsoever beyond the reasonable control of Evergreen Escape Adventure; or an event which Evergreen Escape Adventure or the supplier of services, even with all due care, could not foresee.
ALTERATION BY CLIENT OF CONFIRMED BOOKING
If you have booked a trip with Evergreen Escape Adventure and decide to make changes to that trip prior to arrival, your agent will assist you. However, please note that we reserve the right to charge for any additional administration that may be required.
In case you decide to make alterations to a confirmed booking while in Tanzania, we regret to inform you that no credit or refund is possible for any unused services provided at the cost of your holiday. It is your responsibility to make any necessary changes to your travel arrangements, and Evergreen Escape Adventure will not be responsible for any extras or difficulties that may arise with onward travel as a result of such alterations.
MISCELLANEOUS
Adventure holidays can be exciting but also come with some risks. At Evergreen Escape Adventure, we take safety seriously, and for clients who choose our trekking itinerary, we offer top-notch guides and porters and provide safety equipment where necessary. However, please note that we cannot be held responsible for guides and rangers provided by TANAPA or similar authorities. In case you are unable to complete an activity due to your physical limitations, we regret to inform you that there will be no refund of park fees, and any additional accommodation and/or transport fees arising from such circumstances will not be our responsibility. Please be aware that certain activities may require you to sign a Disclaimer Form before participating.
Delays at the airport, on domestic and international flights. Your airline should make plans for meals, overnight lodging, etc. in the unlikely case of a delay. If you are joining a group and airline delays necessitate additional transfers, etc. for you to join the group, you, the customer, are responsible for covering these costs. If your insurance policy allows it, you should subsequently recover them.
Clients are in charge of procuring their passports, visas, health certificates, international driving licenses, and any other documentation necessary for their trip, as well as covering any additional expenses that may arise from their inability to do so.
TRUST: Payments are typically deposited to our Tanzanian business bank account and held there till your safari is over. Until your tour is over, any payments made will be stored in our company’s bank account.
Major Credit Cards are accepted, but there is a modest administration fee that must be paid.
IMAGES AND MARKETING
As you participate in any Evergreen Escape Adventure tour, please be aware that images, photos, or videos may be taken by other clients and/or Evergreen Escape Adventure representatives or guides that may feature you. By participating in the tour, you give your consent to such images, photos, and videos being taken and agree to give Evergreen Escape Adventure, and its affiliates, and assigns a perpetual, royalty-free, worldwide, irrevocable license to reproduce them for any purpose whatsoever, including marketing and promotions, in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation or compensation payable to you.
AMENDMENTS OF THE TERMS AND CONDITIONS
Evergreen Escape Adventure may amend or alter these Terms and Conditions at any time. The updated Terms and Conditions will be published on the Evergreen Escape Adventure website and will take effect 10 days after they have been posted. The latest version of these Terms and Conditions can be accessed on the website or will be provided to clients upon their written request. By continuing to use Evergreen Escape Adventure’s services, clients will be deemed to have accepted any amendments to these Terms and Conditions 10 days after they have been posted on the website. We recommend that clients review the Terms and Conditions before their travel to ensure they are familiar with the most current version.
PRIVACY POLICY AND HOW EVERGREEN ESCAPE ADVENTURE USES YOUR INFORMATION
Participants are required to provide personal information to Evergreen Escape Adventure to make a booking and receive the products and services they offer. The collection, use, and disclosure of this information is done by the Company’s Privacy Policy, which can be found at http://www.evergreenescapetz.com. As the data controller, Evergreen Escape Adventure collects only the information necessary to provide the requested products and services. This includes sharing information with third-party suppliers and operators who help deliver services or components of the products. All third-party suppliers are bound by the company’s privacy policy. By providing personal information, participants agree to the terms of the privacy policy. The Lead Participant is responsible for obtaining necessary consent from other participants. Evergreen Escape Adventure is committed to following all applicable privacy laws from Tanzania when processing personal data related to their services:
- process that personal data only by the Privacy Policy and to provide the services unless Evergreen Escape Adventure is required by the laws of Tanzania to otherwise process that personal data (for example the issue of invoices showing VAT).
- ensure that it has in place appropriate technical and organisational measures to protect against unauthorised or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data, appropriate to the harm that might result from the unauthorised or unlawful processing or accidental loss, destruction or damage and the nature of the data to be protected, having regard to the state of technological development and the cost of implementing any measures (those measures may include, where appropriate, pseudonymising and encrypting personal data, ensuring confidentiality, integrity, availability and resilience of its systems and services, ensuring that availability of and access to personal data can be restored in a timely manner after an incident, and regularly assessing and evaluating the effectiveness of the technical and organisational measures adopted by it);
- ensure that all Evergreen Escape Adventure personnel who have access to and/or process personal data are obliged to keep the personal data confidential; and
- notify the Participants without undue delay on becoming aware of a personal data breach.
As part of the services provided by Evergreen Escape Adventure, participants may consent to the sharing of their information with third-party suppliers to carry out certain elements of the services.
